Retrenchments
Retrenchment is considered a no-fault dismissal situation, based on the operational requirements of a business such as economical, structural or similar needs and it is regulated by Section 189 and 189A of the Labour Relations Act. HASEA members enjoy meticulous planning, assistance and representation from our Officials throughout retrenchment processes to ensure procedural and substantive fairness and to minimize risks of adverse awards in the CCMA or Labour Court.
