Grievance and Disciplinary Procedures
One of the essential requirements in dealing with discipline of employees is a disciplinary procedure. Proper procedures are mandatory and essential when dealing with misconduct in the workplace. All employers ought to have a detailed document setting out the procedures to be followed and the different sanctions which may be instituted in terms of different degrees of misconduct. Schedule 8 of the Labour Relations Act 66 of 1995 sets out the terms necessary for dealing with discipline of an employee.
Employees of an employer must be provided with the opportunity and procedure to address any matter which is of concern to them. This may be a whole range of issues, some of which are unfair labour practices, harassment, employer-employee relationships, working conditions, to mention but a few. To afford to the employee an opportunity to bring a grievance which they might have to the attention of the employer, it requires that a grievance procedure be made available in the workplace. HASEA is in a position to assist employers/members with the compiling of grievance and disciplinary procedures, as well as to assist with the physical execution of the process, in other words presiding over these matters.
